Ten facts about buying in Benahavís
What the town is, what the market is and what the money looks like. Sources dated.
- Location
- Benahavís is a mountain municipality in the province of Málaga, Costa del Sol, about 6.5 km from Puerto Banús and roughly 40 km from Málaga airport.
- Region and tax
- It sits in Andalusia, so on a resale home you pay ITP at 7% and on a new build IVA at 10% plus AJD stamp duty at 1.2%. Source: BOE-A-2021-17915, as of October 2026.
- Property types
- The town is known for villas and townhouses on hillside plots, with some newer developments. There is very little apartment stock in the town itself.
- Access
- By car via the A-7 motorway and the AP-7. The AP-7 toll road runs along the coast; check current tolls on the operator page before you travel.
- Community and services
- Most homes are in urbanizaciones with a community fee. The town hall (Ayuntamiento) handles the IBI council tax; the figure is on your annual receipt.
- NIE number
- The foreigner identity number is needed for the deposit contract, the deed, the bank account and the utilities. Apply at a consulate or a police station in Spain.
- Lawyer
- Hire your own independent lawyer, not the seller's and not the agent's. A lawyer checks the Land Registry extract (nota simple), debts on the home, the community and the town planning status.
- Land Registry check
- The nota simple shows the owner, the size on record and any mortgage or charge. It costs a few euros and takes a day.
- Off plan
- Every payment made before handover must be covered by a bank guarantee or insurance in your name. Ask for it before you pay the first instalment.
